Tire Defects, Tire Tread Separation, Weak Roofs, and Rollover Accident
A tire defect during manufacturing can result in a tire tread separation. Tire tread separation at highway speeds may cause a rollover and resulting roof crush. A tire tread failure or blowout can cause a SUV to lose control and potentially roll over. Many rollover accidents cause serious injury, even death.
Weak vehicle roofs, roof pillars, roof headers and supports of SUVs, trucks and vans often fail and collapse during rollovers. Rollovers in vehicles with weak roofs often crush the occupants causing spinal cord injury, closed head injuries, paralysis, paraplegia, quadriplegia, anoxic brain damage, and death.
Seat Belt Defects:
Seat belt failures can be the result of poor design or a manufacturing defect. Regardless of the cause, the most important evidence in a seat belt defect case is the seat belt system itself. By looking at the seat belt system an expert can often determine whether the belt performed as intended or not. The clues are not always readily apparent, but if a vehicle occupant is injured or killed under suspicious circumstances, then precautions should be taken to evaluate if a seat belt failure occurred.
As a general matter, seat belts are intended to keep occupants restrained in their seats and to minimize undesired movement during an accident. If the seat belt does not adequately contain an occupant then a claim may arise. For example, if an occupant is ejected despite being belted, then a seat belt defect claim may well exist. Other examples include the unlatching of a belt during an accident, the failure of the seat belt to lock up on impact, or the inability of the belt to adequately protect children.
